Wisconsin Taxation Committee

Meeting Notes of September 6, 2006 
 

The meeting was called to order at 12:06 PM.
 

Dana Erlandsen, WDOR – Chief Legal Counsel and Alex Prost, WDOR – Supervisor of Field Audits presented to the Committee.  Dana provided some background about the legal group, all of whom are currently in Madison.  She also provided some statistical information regarding type of cases, settlements, etc.

 Dana gave an overview of several significant pending cases including:  Menasha, Daimler Chrysler, River City Refuse, Xerox, Schweitzer, and Ho Chunk.

One particular item of note was a request to this committee to continue to bring up issues that the WDOR should be addressing.   

A question and answer session followed.   

Ms. Erlandsen’s presentation concluded at 12:50 at which time the committee took a break. 

The meeting resumed at 1:15 

Motion to approve the June 1, 2006 minutes was made by Daryl Ohland, seconded by Richard Scott. 

Leroy Schmidt provided an update on the following issues:

  • A request to encourage all to participate in CPAC.
  • An appeal to continue to support the profession which is in need of more people entering the field. 
  • The new Executive Director, Dennis Tomorsky, is scheduled to start on October 1, 2006. 
  • WICPA Leadership Dinner scheduled for March, 3, 2007.
  • Leroy thanked the committee for all of its hard work.  The committee then gave Leroy a round of applause to acknowledge his contribution to the committee. 

 

Brian Ertmer provided the Sales & Use Tax Update and there was a brief discussion of the following issues: 

  • WDOR goal that all sales and use tax returns be e-filed by June 2007.
  • WDOR accepting Streamlined Sales Tax Exemption Certificates as valid for only Wisconsin Resale purposes. 
  • The reissued FAQ for Computer hardware in WTB 148. 
  • Cases discussed included:  Craftsmen United, and Visu-Sewer Clean & Seal
  • PLR W0625001 regarding aircraft exemption under WS § 71.53(17r) was discussed. 

 

Greg Butler facilitated the Income Tax Update and there was a brief discussion of the following issues: 

·         Update on the August 14th public hearding for Tax Rule 2.39. 

·         The federal law (HR 4019)

·         Cases discussed included:  Louis Dreyfus Petroleum, Titan International, and Ameritech Publishing.

 

Other Items Discussed during the Open Forum included:

  • WDOR studying REIT transactions.
  • Wisconsin lack of conformity with HSAs.
  • Pass-Through entity withholding.  WDOR has questioned whether or not any hardship exists and is requesting examples.

 

The next meeting is scheduled for January 18, 2007.

Motion to adjourn was made by Richard Scott, seconded by Greg Butler.
