The U.S. Immigration and Customs Enforcement (ICE) has quadrupled its I-9 Employment Eligibility Verification employer audits since 2017, and the numbers continue to rise. In 2017, ICE issued the highest I-9 penalty against an employer in the entire history of I-9s: $95 million USD. As a result, employers are scrutinizing their employees’ I-9 documents more closely. But too much scrutiny can amount to employment discrimination or unfair documentary practices that could trigger a separate audit from the U.S. Department of Justice, civil litigation or both.
