Federal appeals court blocks Biden’s vaccine mandate for employers

November 15, 2021

In response to the Biden administration’s recent COVID-19 vaccine mandate for large employers, a federal appeals court blocked the president’s executive order it considered too overreaching.

On Sept. 9, President Joe Biden issued the two executive orders mandating vaccines for federal workers and announced new requirements for companies with 100 or more employees.

Biden also asked the Department of Labor to issue an emergency rule requiring all employers with 100 or more employers to ensure their workers were either fully vaccinated or tested for the coronavirus at least once a week. The requirement could carry a $14,000 fine per violation under the emergency rule.

Biden’s mandate immediately drew criticism from legislators and employers alike, leading to the federal appeals court’s decision to block it. The dispute will likely work its way up to the Supreme Court, but when that will happen is not yet clear.
