New IRS form to report business identity theft

August 12, 2020

The IRS has released a new form that makes it easier for businesses, estates, trusts and tax-exempt organizations to report identity theft.

Submitting Form 14039-B, a business identity theft affidavit, enables the IRS to more quickly assist victims. The form is for entities whose names or employer identification numbers (EINs) are being used to submit fraudulent tax returns or fraudulent Forms W-2 to facilitate refund theft.

The process for individuals who suspect they are victims of identity theft remains unchanged. Individual taxpayers with rejected Form 1040 returns should file a Form 14039.
